Der Court of Common Pleas war das älteste Common Law-Gericht. Es wurde im späten 12. Jahrhundert eingerichtet und verhandelte Zivilrechtsfälle zwischen den Parteien. Es war das geschäftigste Gericht im 15. Jahrhundert und hatte einen Oberrichter und fünf Unterrichter. Es saß in Westminster Hall und hatte bei Fällen zu Konten (account), Verträgen (covenant), Schulden (debt) und gerichtlichen Rückgabegeboten von illegal gehaltenem Eigentum (detinue) nahezu ein Monopol. Dieses Gericht war auch das teuerste und darum das für Richter, Kontoristen und Rechtsanwälte am meisten profitable. Die Krone profitierte ebenso am Gericht, weil es angewiesen war, jegliche Schulden mit Geldstrafen zu belegen und das persönliche Hab und Gut von Gesetzlosen zu konfiszieren. 1880 verschmolz es mit der King's Bench-Abteilung des High Court of Justice.
Heute gibt es in den USA noch Court of Common Pleas, die aus der englischen Rechtstradition übernommen wurden.
