Nolo contendere

Plea of nolo contendere (auch no contest, stand mute) ist eine mögliche Klageerwiderung in US-amerikanischen Gerichtsverhandlungen und bedeutet den Verzicht auf das Bestreiten der behaupteten Straftat. Nolo contendere kommt aus dem Lateinischen und heißt übersetzt „Ich will nicht streiten“.

Plea of nolo contendere ist eine Alternative zum Plädieren auf „schuldig“ oder „nicht schuldig“ und besagt dass der Beklagte die Schuld weder anerkennt noch abstreitet. Der Angeklagte verzichtet somit auf eine Verteidigung und erkennt das Gerichtsurteil an, ohne eine Gesetzesübertretung zuzugeben. Der unmittelbare Effekt einer nolo contendere-Klageerwiderung ist derselbe wie bei einem Schuldeingeständnis, obwohl technisch gesehen kein solches vorliegt. Im Gegensatz zu einer Verurteilung mit Schuldeingeständnis zählt ein Plea of nolo contendere jedoch nicht für die Feststellung einer Unbelehrbarkeit, welche eine höhere Strafe zur Folge hätte (siehe auch Three-Strikes-Gesetz).

Die Klageerwiderung muss vom Gericht anerkannt werden. Außer bei harmloseren, nicht gewaltbezogenen Vergehen wird Plea of nolo contendere meist abgelehnt. Akzeptiert wird nolo contendere bei kleineren Vergehen - Jenna Bush, Tochter des ehemaligen US-Präsidenten George W. Bush plädierte nolo contendere, als sie im Mai 2001 wegen Alkoholbesitzes als Minderjährige und wegen der Verwendung eines gefälschten Ausweises angeklagt worden war.

Kritiker sind der Meinung, dass durch das Plea of nolo contendere das Vertrauen der Öffentlichkeit in ein faires und akkurates Gerichtsverfahren untergraben wird.
