Nettleship v Weston [1971] 2 QB 691 ist eine Entscheidung des Court of Appeal zum englischen tort law im Bereich negligence. Die zu entscheidende Frage war, ob für den reasonable man-Test auch das Fehlen von Erfahrung von Bedeutung sei.

Sachverhalt

Ein Fahrschüler vergaß nach dem Einlenken in eine Kurve das Lenkrad wieder auf die gerade Straße auszurichten und fuhr gegen eine Straßenlampe. Der Fahrlehrer wurde dabei verletzt. Der Fahrschüler war gegen Personenschäden an Mitfahrern versichert. Der Fahrlehrer verklagte den Fahrschüler auf Schadensersatz für seine Verletzungen.

Entscheidung des Court of Appeal

Der Court of Appeal entschied mit Mehrheit, dass der Klage des Fahrlehrers stattgegeben werden sollte. Lord Denning begründete dies damit, dass auch für einen Fahrschüler derselbe Standard für die duty of care wie für alle anderen Verkehrsteilnehmer gelte und sie diese auch dem Fahrlehrer gegenüber schulde. Da sie versichert sei, solle das Risiko eines Schadens ihr zufallen. Eine abweichende Meinung vertrat Salmon LJ.
