Nexum

Nexum, abgeleitet von nectere (binden), ist ein Begriff aus dem Römischen Recht. Es beschreibt ein schuldbegründendes Geschäft, welches im Zwölftafelgesetz normiert war.

Bei einem Nexum begab sich der Schuldner durch Manzipationsakt zudem in die Gewalt des Gläubigers. Hieraus konnte bei Zahlungsunfähigkeit die Vollstreckungshaft folgen. Wenn kein anderer Ausgleich zustande kam, drohte die ultima ratio, nämlich der Verkauf des Schuldners in die Sklaverei (trans tiberim), als finale Rechtsfolge.

Das Nexum wurde im Verlauf des ausgehenden 4. Jh. v. Chr nicht mehr angewendet; künftig war die Forderungsbegründung nur noch durch Stipulation möglich.
