Date Rape ist nicht einvernehmlicher Geschlechtsverkehr, bei dem weder eine ausdrückliche Verweigerung noch eine Gewaltanwendung stattfindet. Der Tatbestand ist dabei lediglich in der nicht eindeutigen Einvernahme beider Geschlechtspartner zu finden („Ich habe nicht ja gesagt, ich habe aber auch nicht nein gesagt“). Kritiker legen demnach oft entgegen, dass nur aus Schüchternheit oder anderer Einschränkungen nicht widersprochen wurde, es jedoch zu keinem bewussten Akt kam. Dabei kann auch Alkoholeinfluss oder Übermüdung der Auslöser sein. Juristisch erlangt dies jedoch dann erhebliche Relevanz sobald der „Täter“ das Mittel zum Einfluss aktiv und gegenüber der Zielperson unbewusst verabreicht (K.-o.-Tropfen, sog. Date-Rape-Drug).

Als weiteres erschwerendes Kriterium der Einordnung kommt hinzu, dass im Allgemeinen vor vollzogenem Geschlechtsverkehr ein ausgesprochener bzw. ausdrücklicher Konsent der Beteiligten eher unüblich ist. Es fragt normalerweise vorher niemand „Möchtest du jetzt Sex haben, ja oder nein?“ Vielmehr führt auch bei einvernehmlichem Geschlechtsverkehr der Verlauf einer Situation und Handlung zum Akt.

In den USA wird Date Rape als Vergewaltigung nach einer Verabredung verstanden.[1][2] In Australien wird Date Rape definiert als Sex mit einer Person, die man zwar kennt, mit ihr jedoch zuvor nicht näher vertraut war.[3]

In Deutschland gibt es juristisch in den meisten Fällen keine Handhabe, die bei Date Rape in Kraft treten könnte.
