Jus soli

Ius Soli (auch ius soli, Jus Soli, lat. „Recht des Bodens“) bezeichnet das Prinzip, nach dem ein Staat seine Staatsbürgerschaft an alle Kinder verleiht, die auf seinem Staatsgebiet geboren werden. Es wird daher auch als „Geburtsorts- oder Territorialprinzip“ bezeichnet und knüpft die Rechtsfolgen an ein leicht verifizierbares Ereignis an. Das Ius Soli ist in seiner Reinform streng, formal und einfach.

Das Abstammungsprinzip (Ius Sanguinis) ist ein anderes, meist parallel geltendes Prinzip des Staatsbürgerschaftserwerbs und an die Staatsbürgerschaft der Eltern gebunden.

Deutschland

Seit der Einführung von Staatsangehörigkeitsgesetzen galt in Deutschland (Preußen 1842) das Ius Sanguinis als der herrschende Erwerbstatbestand. Seit dem Reichs- und Staatsangehörigkeitsgesetz 1913 galt im Deutschen Reich ein reines Ius Sanguinis. Mit der Staatsangehörigkeitsreform 2000 wurde mit dem sogenannten „Optionsmodell“ ein ergänzendes Ius Soli für die zweite Einwanderergeneration eingeführt[1], bei dem bis zur Volljährigkeit eine doppelte Staatsbürgerschaft besteht und sich die Person dann in der Regel bis zum 23. Lebensjahr für eine Staatsbürgerschaft entscheiden muss (§§ 4, 5 StAG).
