Charter-Partie

Charter-Partie von (carta partita lat. geteilte Urkunde, im Zick-Zack zerschnittene Urkunde) ist eine schriftliche Urkunde über einen Raumfrachtvertrag, Seefrachtvertrag § 557 HGB. Die Charter partie ist eine Beweisurkunde, deren Errichtung beim Seefrachtvertrag von jedem Vertragspartner verlangt werden kann. Eine bestimmte Form ist für die Urkunde nicht vorgeschrieben, doch muss sie die wesentlichen Bestimmungen des Frachtvertrages enthalten, ohne den Frachtbrief zu ersetzen. Maßgeblich für vereinheitlichte Ausarbeitung der Charterpartie ist die Baltic and International Maritime Conference (BIMCO). Sie bedeutet in der Seeschifffahrt, dass ein komplettes Schiff oder ein Teil davon für eine Reise oder für einen bestimmten Zeitraum angemietet wird. Es wird unterschieden zwischen Reisecharter und Zeitcharter. Bei einer Reisecharter wird ein Schiff für eine oder mehrere Reisen gechartert, diese Vertragsform kommt häufig in der Trampschifffahrt vor. Reisecharter gibt es als Voll- oder Ganzcharter (das ganze Schiff) sowie als Teilcharter oder auch Slotcharter. Reedereien oder Speditionen chartern hierfür bei anderen Reedereien Containerstellplätze, sogenannte Slots, um den Kunden häufigere Abfahrtsdichten bieten zu können. Eine Variante ist die Raumcharter für bestimmte Laderäume, zum Beispiel Tanks.
