Uti possidetis

Uti possidetis (latein was ihr besitzt; vollständig Uti possidetis, ita possideatis: wie ihr besitzt, so sollt ihr besitzen) ist eine Ausformung des völkergewohnheitsrechtlichen Effektivitätsgrundsatzes.[1]

Ursprünglich besagte Uti possidetis, dass die Parteien einer kriegerischen Auseinandersetzung das Territorium und andere Besitzungen behalten dürfen, die sie während des Krieges gewonnen und zum Zeitpunkt des Friedensschlusses in Besitz hatten. In ihrer heutigen Ausformung beschränkt sich die Regel auf den Grundsatz der stabilen Grenzen. Anwendung erfuhr und erfährt sie insbesondere im Rahmen der Unabhängigkeit der kolonialen Besitzungen sowie bei der Dismembration oder Sezession von Staaten.
