The Swingin’ Pig Records

The Swingin’ Pig Records war ein Bootleg-Label mit zunächst unbekannter Herkunft das überwiegend LPs und Singles veröffentlichte. Die ersten Veröffentlichungen gab es Anfang der 1980er Jahre. In dieser Zeit erschienen drei Singles und etwa zwanzig Langspielplatten^[1]. Das Label war später eins der ersten das Bootleg-CDs veröffentlichte^[2] und das erste, das die Bootleg-CDs in hochwertigen Boxsets anbot.^[3]

Um 1985 hatte das Label einen Geschäftssitz in Luxemburg und ließ seine Tonträger über ein kleines Plattenlabel in Brakel von Deutschland aus vertreiben. Es wurden nun auch GEMA-Gebühren abgeführt, dabei gingen die verschiedenen Künstler jedoch leer aus. Dies war möglich, weil in einigen europäischen Ländern die Rechte für die Künstler bereits nach 20 oder 25 Jahren abgelaufen waren. ^[4]. Nach massiven Protesten verschiedener Künstler (unter anderem Metallica, The Rolling Stones, Neil Young und Frank Zappa) wurden die Urheberrechte in den betreffenden Ländern geändert und das Label verschwand Mitte der 1990er Jahre vom Markt.

Bekannt wurde The Swingin’ Pig Records vor allen durch seine nicht autorisierten Mitschnitte der Beatles, Led Zeppelin und Rolling Stones. Die LP/CD Box Atlantic City ’89 war die bekannteste Veröffentlichung des Labels. Hierbei handelte es sich um einen digitalen Mitschnitt eines Livekonzertes der Rolling Stones, der bei einer Satellitenübertragung aufgenommen wurde. Die Gruppe versuchte mehrmals die Veröffentlichung zu verbieten. Im Jahr 1991 kam es vor dem Landgericht Hamburg zu mehreren Gerichtsverhandlungen, in deren Folge der Vertrieb für kurze Zeit verboten wurde. Am 22. März 1991 hob das Landgericht das Verbot wieder auf und die LP/CD-Box durfte weiter verkauft werden^[5]. Mit über 70.000 Exemplaren ist es das meistverkaufte Bootleg der Welt^[6].

Insgesamt erschienen etwa 250 Compact Discs, und rund 150 Langspielplatten, sowie drei Singles, zwei Shape-Vinyls von den Rolling Stones. Außerdem erschienen noch einige Promo-Tonträger.

Von den etwa 150 LP-Veröffentlichungen erschienen die meisten auf farbigem Vinyl mit limitierter Auflage.

Veröffentlichungen

Die folgende Auflistung gibt einen Überblick aller bekannten Tonträger des Labels, einschließlich der ersten Bootlegs und Sonderpresseungen. The Swingin’ Pig Records stellte mit TSP 223-2 die Produktion ein. Alle Tonträger jenseits dieser Nummer sind sogenannte Fakes, überwiegend aus Thailand, die über den Bekanntheitsgrad von Swingin’ Pig Records weiterhin Geschäfte machen wollen.

Nach damaliger Rechtslage hat man Künstlern aus Ländern die nicht dem Rom-Abkommen zugestimmt haben, nur diejenigen Rechte gewährt, die deutsche Künstler im jeweiligen Land hatten (Reziprozitätsprinzip). Um 1990 gab es einige Urteile vom BGH und BVG dazu. In dieser Zeit sind viele TSP-Bootlegs entstanden und legal verkauft worden. Heute sind sie illegal, denn die Rechtslage hat sich geändert.
